AIRCRAFT CHARTER TERMS AND CONDITIONS

Please review the inclusions, exclusions, and terms & conditions associated with this booking.

Please note that our quote INCLUDES the following:

  1. Aircraft, crew, maintenance, fuel, and insurance.
  2. Landing fees, en-route charges, approach, VSAT, TASP fees, and passenger taxes, ground handling.
  3. Standard in-flight catering and non-alcoholic liquid refreshments on outbound flights.

Please note that our quote EXCLUDES the following:

  1. Personal Travel Insurance: Each passenger is responsible for obtaining their own travel insurance.
  2. Delays and Diversions: Any delay or diversion due to adverse weather or other factors beyond Air du Cap's control that may affect the safety of passengers, aircrew, and/or aircraft. The captain's decision will be final regarding operational and safety issues, with any additional costs incurred borne by the client.
  3. Visas: Any visas required for the aircrew and passengers, including logistics thereof.
  4. Additional Costs for Passenger-Induced Changes: Additional costs resulting from passenger-induced delays or changes to the itinerary, subject to approval by Air du Cap. Changes adversely affecting flight and duty restrictions as laid down by SACAA and the Company Operations Manual will be refused.
  5. Aircraft Security: Costs to secure the aircraft in the absence of proper security at the airport.
  6. Fuel Surcharges: All fuel surcharges incurred while refueling away from Cape Winelands Airport.
  7. Fuel Price Increases: Any increase in fuel price between the date of the quotation and the actual flight.
  8. Airport After-Hours Surcharge Fees: Fees for airport services outside of regular operating hours.
  9. Diversions: Any diversions due to non-availability of airport lights/services, fuel, customs, or immigration.
  10. Cape Winelands Airport Hours: Cape Winelands Airport closes from 2000 hrs daily until 0600 hrs the following day. This quotation assumes the return to Cape Winelands. In the event of a flight delay necessitating an overnight stay at an alternative airport, all additional charges will be the responsibility of the client.
  11. Pilot Accommodation: Pilots' transport, meals, and accommodation at a reasonable establishment, if a night stop is required, are for the client's account. A day room with transport and meals is required for the crew if the aircraft stops over more than 3 hours.
  12. Insurance Excess and Fees: Insurance excess, royalties, and non-objection fees.
  13. COVID-19 Charges: Any charges related to COVID-19.

TERMS AND CONDITIONS are as follows:

  1. Delays: The Company shall not be held liable for delays arising from unforeseen circumstances, mechanical breakdowns, diversions, adverse weather conditions, or any other cause. However, every effort will be made to address and resolve such situations to the best of our ability.
  2. Luggage Restrictions: Passenger luggage will undergo weighing in accordance with the maximum weight permitted on the aircraft specified in the quote. All luggage must be soft-sided due to limited space. Inspection and approval of all luggage and cargo will be conducted by the pilot in command of the aircraft.
  3. Declaration of Dangerous Goods: It is mandatory to declare any dangerous goods to Air du Cap upon confirmation of the provided quote. Failure to correctly package goods or provide the necessary documentation will result in refusal of carriage.
  4. Clearances: This quote is contingent upon obtaining traffic rights and clearances for the designated routing at the time of acceptance. Clearances must be secured a minimum of three full working days prior to departure and are subject to the respective countries granting over-flight and landing permissions.
  5. Smoking Prohibition: Smoking is strictly prohibited on board any Air du Cap flight.
  6. Payment Terms:
    1. A non-refundable deposit of 50% is required upon confirmation of the flight, with the remaining balance payable at least 72 hours prior to the commencement of the flight.
    2. Payment or issuance of an order number indicates acceptance, agreement, and understanding of these terms and conditions by the client.
    3. All bookings must be confirmed or cancelled in writing (or via our online system).
    4. The quoted price is valid for 30 days, subject to changes in fuel prices and aircraft availability.
    5. A surcharge will be applied for payments made in foreign currency.
    6. Payments are accepted in cash, EFT, or credit card.
    7. Please note that any refunds on card payments will incur 3% card fee
  7. Cancellation Policy:
    1. 20% of the quoted amount if cancelled within 48 hours of the flight.
    2. 50% of the quoted amount if cancelled within 24 hours of the flight.
    3. 100% of the quoted amount if cancelled on the day of departure.
  8. Technical Stops: Air du Cap reserves the right to include technical stops en route without prior notification, with no additional charge to the client. Such stops will be made solely in the interest of safety.
  9. Operating Hours: The quoted service is subject to daylight and airport operating hours only.
  10. Claims: Claims for injury, death, or lost/damaged baggage must be brought within specified timeframes as outlined in the terms and conditions.
  11. Governing Law: The agreement between you and Air du Cap shall be governed by and interpreted in accordance with the laws of the Republic of South Africa. Both parties agree to the exclusive jurisdiction of the South African courts. By accepting this quotation/invoice, you confirm that you have read, understood, and accepted our standard terms and conditions attached hereto. Any separately negotiated, agreed upon, and signed terms and conditions with us shall supersede our standard terms and conditions.
